SparkPage Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SparkPage.


1. Acceptance of Terms

By accessing, browsing, creating an account, or using SparkPage (the “Service”), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use SparkPage.


2. What SparkPage Is

SparkPage provides a platform that allows patients, parents, caregivers, and families to create personal, informational microsites to share stories, experiences, and educational information related to rare or complex medical conditions.

SparkPage:

  • is intended for storytelling, awareness, and informational purposes
  • does not provide medical advice
  • does not process payments, donations, or fundraising
  • does not sell, license, or commercially monetize user-generated content

SparkPage is not a healthcare provider, medical organization, or advocacy group.


3. Eligibility

To create an account or publish content, you must:

  • be at least 18 years old, and
  • have the legal authority to agree to these Terms.

SparkPage may be used by:

  • adult patients,
  • parents or legal guardians of minors, or
  • authorized caregivers acting with permission.

Children may not create accounts or independently publish content.

SparkPage complies with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13. Parents or legal guardians who create content about children are responsible for ensuring they have the legal authority to share such information.


4. User Responsibilities

By creating an account or publishing content on SparkPage, you represent and agree that:

  • You have the legal right to upload, publish, and share all content you submit, including photographs, videos, and written materials.
  • If your content involves a child, you are the child’s parent, legal guardian, or have lawful authorization to share that content.
  • Content is shared for informational and personal storytelling purposes only, not as medical guidance.
  • Content is accurate to the best of your knowledge and not intentionally misleading.
  • You will not use SparkPage to harass, defame, exploit, or harm others.
  • You are solely responsible for all content you publish and any consequences arising from it.

5. Prohibited Uses

You may not use SparkPage to:

  • publish hate speech, harassment, threats, or abusive content
  • share content that violates another person’s privacy, publicity, or intellectual property rights
  • impersonate any person or organization
  • upload content you do not have permission to share
  • promote unrelated commercial products or services
  • solicit donations, fundraising, or financial contributions
  • provide medical, legal, or professional advice
  • attempt to circumvent security or access controls

SparkPage reserves the right to remove content or restrict access that violates these Terms.


6. Medical Disclaimer

SparkPage does not provide medical advice, diagnosis, or treatment.

All content on SparkPage is provided for general informational and personal storytelling purposes only.

Always seek the advice of a qualified healthcare professional regarding any medical condition or treatment decisions. Never disregard professional medical advice because of content found on SparkPage.


6.1. Health Information & HIPAA

By using SparkPage, you acknowledge that:

  • You are voluntarily sharing health information, medical conditions, and personal health details.
  • SparkPage is not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA).
  • SparkPage does not provide healthcare services, process medical claims, or maintain protected health information (PHI) in a HIPAA-regulated manner.
  • Content you publish on SparkPage is not subject to HIPAA protections.
  • You are responsible for understanding the privacy implications of sharing health information when you publish your microsite.

If you have concerns about sharing health information, consult with your healthcare provider or legal advisor before publishing content on SparkPage.


7. Content Ownership & License

You retain full ownership of all content you submit to SparkPage.

By submitting or publishing content, you grant SparkPage a limited, non-exclusive, royalty-free, worldwide license to host, store, display, reproduce, and distribute your content solely for the purpose of operating and displaying the Service.

This license ends when your content is removed from SparkPage, except to the extent content may remain in backups or logs for legal or operational purposes.

SparkPage does not claim ownership of user stories, images, or personal content.


8. Visibility & Sharing Controls

You control whether your microsite is:

  • Published: Accessible by anyone with the link
  • Unpublished: Not accessible on the internet (this is like 'draft' mode)

SparkPage does not:

  • index microsites in internal search results,
  • rank or promote individual pages, or
  • publicly list microsites.

You are responsible for how, where, and with whom you choose to share your microsite link.


9. Content Moderation & Removal

SparkPage may remove or restrict access to content if we reasonably believe it:

  • violates these Terms,
  • infringes on the rights of others,
  • poses a privacy or safety risk, especially involving children,
  • is misleading in a way that may cause harm, or
  • is required to be removed by law.

When appropriate, we will attempt to notify the account holder, but we are not required to do so prior to removal.


9.1. Copyright & DMCA Takedown Procedure

If you believe that content on SparkPage infringes your copyright, you may submit a takedown notice under the Digital Millennium Copyright Act (DMCA).

To file a DMCA takedown notice, please send the following information to support@sparkpage.org:

  • Your contact information (name, address, phone, email)
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing content (with specific URL)
  • A statement that you have a good faith belief that the use is not authorized
  • A statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

SparkPage will review valid DMCA notices and may remove or disable access to the allegedly infringing content. We may also notify the account holder and provide an opportunity to submit a counter-notification.

If you believe your content was removed in error, you may submit a counter-notification with:

  • Your contact information
  • Identification of the removed content
  • A statement under penalty of perjury that the content was removed by mistake
  • Your consent to jurisdiction in New Jersey and service of process
  • Your physical or electronic signature

10. Account Suspension or Termination

SparkPage may suspend or terminate accounts for:

  • repeated or serious violations of these Terms,
  • abuse or misuse of the platform,
  • legal, safety, or child-protection concerns.

You may delete your account at any time through your account settings or by contacting support.

Upon termination:

  • Your access to the Service will end immediately.
  • Your content will be removed from public access within 30 days of account deletion.
  • Content may remain in system backups for up to 90 days for operational and legal purposes, after which it will be permanently deleted.
  • You may request expedited deletion of specific content by contacting support, subject to legal and operational requirements.

SparkPage is not responsible for retrieving or exporting your content after account termination. We recommend exporting or saving any content you wish to retain before deleting your account.


11. Third-Party Links & Content

SparkPage microsites may include links to third-party websites or resources.

SparkPage does not control, endorse, or assume responsibility for any third-party content, services, or websites. Accessing third-party resources is at your own risk.


12. Disclaimer of Warranties

SparkPage is provided “as is” and “as available.”

To the fullest extent permitted by law, SparkPage disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free.


13. Limitation of Liability

To the fullest extent permitted by law:

  • SparkPage is not responsible for user-generated content.
  • SparkPage is not liable for how content is interpreted, shared, or used by others.
  • SparkPage is not liable for any indirect, incidental, or consequential damages.

SparkPage’s total liability for any claim is limited to the amount you paid to use the Service — which is $0.


14. Indemnification

You agree to indemnify and hold harmless SparkPage and its operators from any claims, liabilities, damages, losses, or expenses arising out of:

  • your use of the Service,
  • your content, or
  • your violation of these Terms.

15. Changes to These Terms

We may update these Terms from time to time.

Changes will be effective when posted, as indicated by the “Last updated” date. Continued use of SparkPage after changes constitutes acceptance of the updated Terms.


16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved in the state and federal courts located in New Jersey, and you consent to the exclusive jurisdiction and venue of such courts.

If you are located outside the United States, you acknowledge that:

  • SparkPage is operated from the United States.
  • Your use of the Service may be subject to local laws in your jurisdiction.
  • You are responsible for compliance with applicable local laws.
  • Certain rights and protections may vary by jurisdiction.

For users in the European Union, additional rights under the General Data Protection Regulation (GDPR) are described in our Privacy Policy.


17. Service Modifications & Termination

SparkPage reserves the right to:

  • modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice,
  • change features, functionality, or availability of the Service,
  • impose limits on usage or access to the Service.

If SparkPage discontinues the Service:

  • We will provide at least 30 days' notice when reasonably possible.
  • You will have the opportunity to export your content during the notice period.
  • After discontinuation, your content will be permanently deleted in accordance with our data retention policies.

SparkPage is not liable for any loss or damage resulting from modifications, suspension, or discontinuation of the Service.


18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
